The construction sector underwent a significant transformation with the implementation of the Building Safety Act 2022 (BSA). Effective from October 1, 2023, a new dutyholder framework was introduced for all construction projects, with limited exceptions. This entails the mandatory appointment of a 'Principal Designer' and 'Principal Contractor' for the majority of construction endeavors, each with their own specific obligations and competency criteria.
Although the titles 'Principal Designer' and 'Principal Contractor' may seem familiar, they hold distinct roles under the Building Safety Act, separate from those defined in the Construction (Design and Management) Regulations 2015 (CDM Regulations). Despite sharing identical labels, the responsibilities and skillsets required for these roles under the BSA are different from those outlined in the CDM Regulations.
